“Wij bieden sinds 1 januari geen toegang meer tot betaalde inhoud van de FD website. Het consortium van universiteiten en FD media (het bedrijf achter Het Financieele Dagblad) werden het niet eens over dataverzameling en privacy. Als u gebruik maakt van digitale bronnen die de Universiteitsbibliotheek aanbiedt, wordt uw data minimaal gedeeld en zoveel mogelijk geanonimiseerd. Om de FD website te gebruiken moeten gebruikers echter nog een account aan maken en akkoord gaan met voorwaarden van FD Media, waarin o.a. toestemming wordt gegeven voor het verzamelen van data. Met deze extra dataverzameling zijn de universiteiten niet akkoord gegaan. 

U kunt echter veel van de artikelen uit Het Financieele Dagblad ook vinden in Nexis Uni:

  • Ga naar https://libguides.eur.nl/nexisuni.
  • Klik op Bronnen, te vinden rechts in de bovenste balk.
  • Vul "Het Financieele Dagblad" in de zoekbalk onder Zoek bronnen en druk op het vergrootglas icoontje
  • Klik op Het Financieele Dagblad in de zoekresultaten. De artikelen zijn vervolgens geordend op datum: nieuwste eerst.

Let wel: Nexis Uni bevat alleen de tekst van artikelen. Toegang tot bepaalde artikelen van freelancers en andere bronnen binnen Het FD (bijv. columns en advertenties) zijn niet altijd beschikbaar.”

Due to a breakdown in negotiations between FD Media and SURF B.V., the University Library’s EUR license with FD Media for the Financieele Dagblad (FD) will not be renewed.

SURF negotiates with various publishers on behalf of universities and universities of applied sciences in the Netherlands. The reason for the breakdown in negotiations is that FD Media does not meet SURF's requirements regarding privacy and anonymous access. EUR's access to the FD will end on 1 January 2025.

Introduction:
Researchers will sometimes find references to publications which are not available anywhere. There is a catalogue reference, a reference at a book-sellers platform or a reference in another publication. And then you cannot find it and your library informs you they cannot provide it.

But surely it must exist? Why else are there references within other books or catalogues? And the reference is 10 years old!

Congratulations, you might have found a Ghost Publication; a publication that was (is) planned but did not come into being (yet).


Ghost creation
There are 2 ways for Ghost Publications to come into being:

  • The author/publisher cancelled the publication, but references were added to catalogues and websites.
  • The publication is (still) forthcoming, and references were added to catalogues and websites in advance.

Publications that never were
The publication was announced. Libraries pre-ordered it and added it to the catalogue, booksellers already added it to their platform, authors added it to their literature lists… This was in anticipation of it becoming available…. And then it was cancelled by the author or the publisher. The reference still exists, but to a publication that never was.


Publications that will come…. probably…
And sometimes the publication is still forthcoming… but just takes some time. With the ‘some’ being relative; 5 years, 10 years, 15 years… it is all possible and has happened before. 
This might also result in the cancellation of the publication if it takes too long or if the author passes away.
And perhaps…. it might really come into being, any day now…


What can you do?
If there is a Ghost Publication you are really interested in, your best option is to contact the author and inquire. Perhaps the publication has a new title…. or perhaps the author can share the manuscript with you.

Rechtsorde heeft ‘GenIA-L’ geïntroduceerd, een generatieve AI-toepassing. Deze toepassing geeft je als gebruiker een andere methode om antwoorden te vinden op jouw juridische vragen, naast de traditionele manier van zoeken.

Wat levert deze toepassing?
GenIA-L voegt de beste zoekresultaten samen tot één alinea die jouw zoekvraag tracht te beantwoorden. Bij dit gegenereerde antwoord wordt verwezen naar de originele documenten en worden de gebruikte referenties getoond. Het gegenereerde antwoord kan dan ook geverifieerd worden.

Vervangt GenIA-L de traditionele manier van zoeken?
De traditionele manier van zoeken zal niet worden vervangen en blijft naast GenIA-L bestaan. Als je GenIA-L gebruikt krijg je dezelfde resultaten als bij de traditionele standaardmethode, maar dat resultaat staat onder het gegenereerde antwoord en zal dan ook minder opvallen.

Welke bronnen worden gebruikt door GenIA-L?
Dit is afhankelijk van 2 factoren; de abonnementen van de EUR, én de toestemming van deze uitgevers om hun inhoud door GenIA-L te laten doorzoeken en gebruiken.

Naast openbaar beschikbare documenten, zoals wet- en regelgeving en jurisprudentie, komen alleen documenten waar de EUR een licentie op heeft terug in de referenties. Heeft de EUR geen licentie? Dan worden deze documenten niet gebruikt door GenIA-L. Momenteel worden documenten van de volgende uitgevers gebruikt:

  • Ars Aequi
  • Den Hollander
  • SDU
  • M.A.D.Lex (VAST)
  • Uitgeverij Paris

Daarnaast is Rechtsorde nog in gesprek met andere uitgevers om hun documenten te laten doorzoeken en gebruiken door GenIA-L. Deze documenten worden nu nog niet door GenIA-L gebruikt en dit betreft documenten van de volgende uitgevers waarop de EUR een licentie heeft:

  • Wolters Kluwer
  • Boom Uitgevers

China Law & Reference contains laws, administrative-, departmental-, local-, and military regulations, judicial interpretations, industry standards, and treaties of the People's Republic of China. Also available are 500+ cases, over 3200 articles, 72 commentaries, and over 28.000 Law Expresses (news items).

The documents are available either in Chinese or English, with treaties and regulations being available in a double-language overview.

Access is on IP-basis, so using it from outside the campus requires you to use eduVPN.

Deze databank is nog in ontwikkeling en nieuwe inhoud, waaronder verdere rechtsgebieden, wordt gedurende het jaar toegevoegd. Ook rechtspraak van voor 2015 is zeer beperkt voorzien van extra informatie. Op dit moment is informatie van de volgende 4 rechtsgebieden beschikbaar:

- arbeidsrecht
contractenrecht
ondernemingsrecht
- insolventierecht

Inhoud
Veel van de inhoud is ook beschikbaar via Kluwer Navigator, maar InView concentreert deze inhoud en voorziet deze van extra informatie, waardoor het mogelijk is om sneller tot de essentie van zowel wetsartikelen als uitspraken te komen. Hiertoe biedt InView voor de beschikbare rechtsgebieden 2 ingangen; research en zaakanalyse.

Research biedt de mogelijkheid sneller tot de essentie van een onderwerp te komen doordat de informatie geconcentreerd  wordt; informatie over een wetsartikel wordt in 4 delen aangeboden:

  • Oriëntatie: een inleiding tot het onderwerp bevattende de tekst van het wetsartikel, aangevuld met de behandeling in de Tekst & Commentaar, verwijzing naar gerelateerde onderwerpen, en belangrijke rechtspraak.
  • Verdiepend: een overzicht van besprekingen van het wetsartikel in tijdschriftartikelen en naslagwerken. Als Legal Intelligence is geactiveerd bij integraties dan worden ook de daar aanwezige verwijzingen getoond. Zie integraties voor beschikbare materialen via Legal Intelligence.
  • Jurisprudentie:  uitspraken die verband houden met het wetsartikel. Hierbinnen is het mogelijk te filteren op rechtbank, datum, en rechtsgrond.
  • Ontwikkelingen: een overzicht van de laatste uitspraken, aangevuld met een grafisch overzicht het aantal uitspraken over het onderwerp sinds 2000 (uitspraken voor 2015 worden bijna niet weergegeven). 

Zaakanalyse biedt de mogelijkheid om snel tot de essentie van een uitspraak te komen doordat de uitspraken worden toegelicht met de relevante rechtsgronden én de beoordeling daarvan door de betreffende rechtbank en het betreffende fragment van de uitspraak.

Zaakanalyse

Zaakanalyse geeft verder een inzicht in trends betreffende rechtsgronden zoals het aantal zaken per jaar, hoe (vervuld, onvervuld, anders) een rechtsgrond wordt beoordeeld, de beoordeling per instantie, en het aantal uitspraken per type gerecht. Het is mogelijk hierbinnen te filteren.

Verder is er een overzicht beschikbaar van alle (beschikbare) zaken waarin de specifieke (of hogere) rechtsgrond ter sprake is gekomen.

Zaakanalyse is op gebaseerd op door rechtspraak.nl openbaar gepubliceerde rechtspraak vanaf 2015. Bij eerdere rechtspraak ontbreekt de beoordeling.

Verdere opties
Inview biedt ook (tijdschrift en boek) uitgaven aan op de beschikbare rechtsgebieden, deze informatie is ook volledig beschikbaar via Navigator.
De Modellen voor de Rechtspraktijk zijn dezelfde als in Navigator, maar alleen modellen van de 4 rechtsgebieden zijn beschikbaar via InView.
De optie om te abonneren op nieuws is welkom, maar werkt nog niet naar behoren.

Uitspraken van de Hoge Raad worden tevens voorzien van een tijdslijn met daarop voorgaande uitspraken, beroepschriften, conclusie van de A-G, en de uitspraak van de Hoge Raad. Doordat deze informatie opvraagbaar is, is het mogelijk de ‘ontwikkeling’ van een uitspraak van de Hoge Raad te volgen.



Integraties
Inview kan geintegreerd worden met een aantal andere platformen. Hierbij raad ik vooral de integratie met Legal Intelligence aan, aangezien hierdoor meer bronnen en materialen beschikbaar komen binnen de optie 'Research: verdieping'

Fastcase is available in 2 forms; Basic and Premium. The EUR has access to Fastcase Basic, as that is included at no costs in our subscription.

Fastcase Basic provides

  • case law linking: linking to US case law within articles and documents
  • citation look-up: looking up case law in Fastcase
  • negative treatment indicator: when viewed in Fastcase, a negative treatment indicator will show whether the case was reversed or overturned on any grounds
  • scholar check, providing information on the number of articles a case has been cited in, with a direct link to the list of these articles

The Open and Responsible Science program (ORS) wishes to recognize projects that include open, transparent, inclusive, and responsible scholarship practices. In November 2022, ORS will award separate prizes to celebrate commitment to three important pillars of open science:

  • Open Research
  • Open Education
  • Societal Engagement

The winners in each category will receive €2500 to be invested in research and educational materials.

Eligibility Criteria
Eligible projects must fulfill the following criteria:

  • Carried out by academic and/or support staff employed at EUR and/or Erasmus MC at the time of submission. Examples: PhD candidates, postdoctoral researchers, lecturers, assistant/associate/full professors, data stewards, software engineers.
  • Projects carried out by visiting staff with EUR and/or Erasmus MC affiliation at the time of submission are also eligible.
  • Demonstrable implementation of one or more open research practices in the research project or educational activity (see Examples of Open Scholarship Practices section).
  • The project has not received the ORS Award in previous editions.

Submission Procedure

  • Self-nominations (i.e., projects the nominees have participated in) as well as nominations of other projects are welcome.
  • Submissions will be accepted from August 23rd 2022.
  • The submission deadline is September 30th 2022.
  • Applicants must send an email to ors.award@eur.nl, with the following information in attachment:
    • An application letter (max. one page) introducing the project, clarifying for which award it is nominated, and why the application warrants consideration.
    • An appendix (max. one page) with a short description (one paragraph) and corresponding direct links to 1 project that demonstrates the relevant open research practices (see Examples of Open Scholarship Practices section).
    • Apart from the application letter and the appendix, no further material will be considered.
  • If projects are nominated by someone who was not directly involved in the work, the project team will be notified and given the opportunity to supplement their application with information that the nominator might not be aware of. This procedure aims to level the playing field by allowing all teams to present the information they deem relevant for the award.
  • Teams including early-career researchers from underrepresented groups as well as research support staff are especially encouraged to apply.
  • The jury will only consider projects from the last 5 years (i.e.,. developed and/or published between 2018 and 2022).

Examples of Open Scholarship Practices

Open scholarship practices include (but are not limited to):

  • Open access publication: gold, diamond, and/or green (on a preprint server, e.g. MedRxiv, BioRxiv, PsyArXiv, or institutional repository, e.g., Pure)
  • Public sharing of analysis code, materials, data, and/or hardware schematics (e.g., on GitHub, EUR Data Repository, OSF)
  • Public preregistration (e.g., on OSF Registries, EU Clinical Trials Register)
  • Registered Report accepted at Stage I or Stage II
  • Creating and/or contributing to open source software and/or publishing a data/software paper (e.g., on the Journal of Open Source Software)
  • Creating and/or contributing to open educational materials (e.g., publicly available course slides, MOOCs, The Turing Way)
  • Engaging the public and/or service users in the research and educational process (e.g., science communication, citizen science projects, living labs)
  • Conducting “research on research” (e.g., metascience, philosophy of science)
  • Engaging in open peer review, pre- or post-publication (e.g., PubPeer)

This list is not exhaustive. We will consider any other practices that contribute to transparent and engaged scholarship.

Evaluation Procedure

The jury consists of academics and professional staff knowledgeable about various aspects of open scholarship practices.

Applications will be evaluated based on the following criteria:

  • quantitative assessment, e.g., the number of open scholarship practices the project includes;
  • qualitative assessment, a cursory assessment of how open scholarship practices have been implemented (e.g., whether open data are properly described to facilitate reuse, or the specificity of a preregistration).

Qualitative assessment will account for the majority of the evaluation.

Applications will be evaluated in two rounds. In the first round, each application will be evaluated by at least two jury members[1] based on the aforementioned criteria and assigned a rank. In the second round, the top 3 applications for each award will be evaluated by all jury members and the award winners will be selected. Should multiple projects be equally ranked, the winner will be selected at random.

The EUR now has unlimited, DRM-free access to this book on day fines in Europe.

Pecuniary fines are a form of punishment for criminal offences and the one most people encounter on a regular basis, for example in the form of fines for traffic offenses. Many jurisdictions work with a system where the fine reflects the severity of the offense and is fixed based on the offense: so-called fixed fines. However, the fixed fine is problematic when the fine can be completely disregarded by the offender as a result of the offender's wealth; if an offender has a million euro's, a fine of € 1000,- is nothing, while a similar fine for an unemployed offender will be a big deal. To prevent inequality regarding punishment for offenses between the wealthy and the poor, the day fine is a possible solution, one where both the severity of the crime and the financial state of the offender can be taken into account.

This book analyses the system of day fines in the currently implementing countries in Europe, the challenges regarding implementation and practice, and the advantages and disadvantages of the system compared to fixed fines.

Jus Mundi is a new search engine and the legal content indexed is gathered from three key sources: partnerships with international organizations, contributors, and local public sources. A search engine under development, the current materials cover Investment Arbitration, International Trade Law, and Commercial Arbitration. Plans for the future include adding more areas of law, such as Sports Law and Environmental Law.

Also interesting are their Wiki Notes: encyclopedic articles on legal topics. These are currently mostly focusing on the subject of Investment Law and Arbitration, although articles on the subject of International Sports Law and Arbitration are in the making.

Due to the tightened corona-measures some limitations are in effect:

  •  the library will be open from 9.00-17.00 every day;
  • Reservations for a study space can be made no more than 2 days in advance;
  • The Library will also be closed on the 25th of December and the 1st of January;

    Furthermore:
  • It is mandatory to wear a face mask when moving around in the Library;
  • Keep a safe distance from others (of at least 1,5 meters);
  • Stay home if you have symptoms of a cold or the flu;
  • Come alone;
  • Test yourself before going to the Library.

Ebook available at EUR: Being well in academia : ways to feel stronger, safer and more connected

There are many challenges to working in an academic setting, and rates of mental ill-health are disproportionately high in both student and university staff populations. Fortunately, universities are increasingly acknowledging and tackling this issue, and more resources are becoming available to help those who work in academia to be well and advocate for their mental health.  Erasmus University Library recently acquired Being Well in Academia: Ways to Feel Stronger, Safer and More Connected by Petra Boynton. This book is an excellent resource for everyone who works in academia, whether they are struggling with well-being themselves or wish to support someone who may be struggling. A member of the LGBTIQ* community herself, Boynton takes great care to be inclusive of different backgrounds, noting the unique experiences of and providing resources for people of colour, disabled people, neurodiverse people and the LGBTIQ* community and those with intersectional identities. Importantly, Boynton accounts for structural causes of mental and physical ill-health such as racism, poverty and trauma, referencing the ‘Unrecovery Star’ developed by Recovery In The Bin (p 77). For those who may be triggered by some of the content, Boynton includes passages on staying safe as you read, self-care and a detailed table of contents so that parts can be avoided if necessary.

After the book is introduced in Chapter 1, Chapter 2 is dedicated to the critical process of creating and maintaining your support network, taking an expansive view including pets, social media and your doctor. Chapter 3 explores the notion of giving and receiving care, providing a loose template for a care plan and step-by-step guide to seeking help. Information on helping others includes a detailed list of practical suggestions for how to effectively help others without sacrificing your own wellbeing, how to spot if a friend or colleague is in a crisis, and how to be an active bystander to address unacceptable behaviour in the workplace. Chapter 4 contains a detailed checklist of things readers may desire, require or be entitled to in the way of help, such as reasonable accommodations, financial information and assistance and training, followed by suggestions for how to help yourself. Chapter 5 is a glossary of ‘threats to your wellbeing’ with suggestions for strategies and resources to try. A handy table of warning signs and symptoms is provided in Chapter 6 to identify if you or another person are in distress, followed by suggestions of how to deal with distress. The question of how to look after yourself is covered in Chapter 7, including practical tips on what to do when you are overwhelmed, how to craft everyday rituals and routines, maintaining boundaries, nourishing yourself and connecting with nature. Finally, Chapter 8 considers future plans, including whether leaving academia is right for you, how to make a skills inventory, and how to reflect at the end of the work day.

Being Well in Academia is structured in an accessible, easily digestible format with bite-sized pieces of information and handy cross-referencing of themes in the margins. While it is not a workbook, the author has provided space for readers to note their responses or fill in further information in some sections. Short exercises are dotted throughout, inviting the reader to do written or mental exercises such as writing a list of all their positive personal characteristics. Each short section is followed by a ‘find out more’ section with links to relevant resources, though these tend to be websites from the US, UK, Canada and Australia. Being Well in Academia is not necessarily a book to read from beginning to end, but rather to dip into as the various challenges of academic life arise. Students, teachers and support staff alike would benefit from sharing this resource widely and normalising conversations about taking care of ourselves and one another at university.

Recent doneerde prof. dr. Philip Hans Franses een exemplaar van zijn studieboek, Kwantitatief inzicht voor juristen, aan de universiteitsbibliotheeKwantitatief inzicht voor juristenk. 

Erasmus Universiteit Rotterdam, van oorsprong de Nederlandse Handels-Hoogeschool en van 1939 tot 1973 de Nederlandse Economische Hoogeschool, heeft een speciale relatie met data: zonder gebruik en bewerking van kwantitatieve data is het moeilijk handel te drijven of onderbouwde economische keuzes te maken.

Voor juristen is werken met kwantitatieve data van belang: de berekening van kansen en het maken van inschattingen kan invloed hebben op juridische overwegingen en argumenten.
Dit geldt ook voor de rechtseconoom: hoe berekent men aan de hand van kwantitatieve data de (mogelijke) gevolgen van rechtsontwikkelingen om hun wenselijkheid te evalueren?
